FlowTherm Systems is a subsidiary of CALIFORNIA HYDRONICS CORPORATION.
California Hydronics Corporation and its operating divisions and subsidiaries (collectively “California Hydronics Corporation”) maintain and operate this and other websites (collectively the “California Hydronics Corporation Sites”) for informational purposes only.
Registration for sites
Some pages of the California Hydronics Corporation Site may be password protected. In the interest of safety and security of the business transactions, only registered users may access said pages. California Hydronics Corporation reserves the right to deny registration to any user. California Hydronics Corporation particularly reserves the right to determine certain sites, which were previously freely accessible, subject to registration. California Hydronics Corporation is entitled, at any time and without obligation to give reasons, to deny the user the right to access the password-protected area by blocking the user, in particular if the user:
Uses false data for the purpose of registration
Violates these terms and conditions
Neglects its duty of care with regard to user data
Violates any applicable laws in the access to or use of the California Hydronics Corporation website
Did not use the California Hydronics Corporation website for a long period
For registration, the user shall give accurate information and, where such information changes over time, update such information (to the extent possible: online) without undue delay. The user shall ensure that its e-mail address, as supplied to California Hydronics Corporation, is current at all times and an address at which the user can be contacted.
Upon registration the user will be provided with an access code, comprising a User ID and a password (“User Data”). On first access the user shall promptly change the password received from California Hydronics Corporation into a password known only to the user. The User Data allows the user to view or change its data or, as applicable, to withdraw its consent to data processing.
The user shall ensure that User Data is not accessible by third parties and is liable for all transactions and other activities carried out under its User Data. At the end of each online session, the user shall log-off from the password-protected websites. If and to the extent the user becomes aware that third parties are misusing its User Data, the user shall notify California Hydronics Corporation thereof without undue delay in writing, or, as the case may be, by e-mail. After receipt of this notice, California Hydronics Corporation will endeavor to deny access to the password-protected area under such User Data. Access by the user will only be possible again upon the user’s application to California Hydronics Corporation or upon new registration.
The user may at any time request termination of registration in writing, provided that the deletion will not violate the proper performance of contractual relationships. In such event California Hydronics Corporation will remove all User Data and other stored personally identifiable data of the user as soon as these data are no longer needed.
Information and Documents
By using the California Hydronics Corporation Sites or downloading documents, materials or information (hereinafter “Material”) from them, you agree to be bound by the Legal Conditions set forth in this notice. If you do not wish to be bound by these Legal Conditions, leave immediately, do not use and do not download any Material from this or any other California Hydronics Corporation Site.
International Users, Choice of Law and Jurisdiction
The California Hydronics Corporation Sites and the Material contained in them shall be deemed to be provided in the state of New York in the United States of America and you agree that the law governing these Legal Conditions or your use of a California Hydronics Corporation Site shall be the laws of the state of New York without regard to any principles of conflicts of law. You further agree that any disputes arising under these Legal Conditions or from your use of a California Hydronics Corporation Site shall be submitted exclusively to the courts in the state of New York and that you will not assert jurisdiction in any other court or tribunal anywhere in the world. California Hydronics Corporation makes no representation that the Material at the California Hydronics Corporation Sites is appropriate or available for use at locations outside of the United States. Access to the Materials from territories where the Materials are illegal is prohibited.
As a convenience to you, California Hydronics Corporation may provide links to websites operated by other entities, but makes no warranty or representation whatsoever about any linked site and does not imply an affiliation or association with any such site. If you visit or use a linked site, you do so at your own risk.
All materials on, distributed through or accessible from, the California Hydronics Corporation Sites are provided “as is” and “as available,” without warranty of any kind, expressed or implied including but not limited to the implied warranties of merchantability, fitness for particular purpose, or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
